BREEDING CONTRACT

　I here by agree to breed my mare __________________________________________________, Reg. No. ______________________ to the stallion, Nicks Huachuca, for the 2008 season at $1,500.00. A booking fee of $400.00 is payable and must be returned with this contract. The balance of breeding fee of $1,100.00 must be paid when mare is picked up. All veterinary expenses are billed monthly and must be paid when mare is picked up.

Live foal guarantee with return privilege the following season, only if the mare fails to produce a live foal after being sent home in foal. It is understood that should the foal not stand up and nurse, I will be entitled to a return privilege the following year. This guarantee applies only if I notify you within one week of death of foal. A statement must accompany this notice from a licensed Veterinarian. If the mare is to be returned and the owner of the mare fails to deliver her for rebreeding the following year, then any and all fees shall not be refundable, and this contract is there by cancelled.

Diligent efforts will be made to settle my mare, however, if for any reasons she does not settle, I will not hold the stallion owner or his representatives liable. The breeding season will begin February 15 and close July 15.

Live foal guarantee by stallion owner will be void and stallion owner will be released from all liability if the above stallion dies or becomes unfit for service. It is further understood that should the stallion die, sold by owner, or become unfit for service prior to settling the mare, this contract shall become null and void and my breeding fee will be returned, if it has been paid in full. If mare dies or becomes unfit to breed before a positive pregnancy exam, the Breeder has the option to either accept another mare as a replacement according to paragraph 6 and 7 or refund breeding fee (minus the booking fee), if already paid in full, canceling this entire contract.

A Breeders Certificate will be issued upon notification of birth of the foal, and after all fees and expenses have been paid in full.

The Mare’s Registration Certificate or Photostatic Copy of the front and back of the certificate must be furnished.

All mares must have veterinarian health certificate, coggins test and current vaccinations (Rhino Pneuminitis must be included).

Mares not halter broke will not be accepted.

I understand and agree that Iron Mill Ranch (the "Ranch") and/or any of their representatives will not be responsible for accidents affecting death of my mare and/or foal. Furthermore I agree that the Ranch shall not be held liable for any negligence or errors and that the Ranch may exercise their judgement in supervising and caring for mares. I agree that the Ranch assume no liability whatsoever for the mare or the mare owner.

I agree that the Breeding Manager may have a veterinarian check my mare for normal breeding conditions and to perform such other veterinarian services as the Breeding Manager deems necessary at Mare Owner’s expense.

The parties acknowledge that this agreement is made and shall be considered to be entirely performed within the state of Texas and shall be construed and enforced under the laws of the state of Texas. Under Texas law (Chapter 87, civil practice and remedies code), an Equine Professional is not liable for an injury or the death of a participant in Equine activities resulting from the inherent risks of Equine activities.

Please fill out contract completely, one per mare, and send with your check to Iron Mill Ranch in the amount of $400.00 for each mare to be bred. When contract is received, copies will be made and sent back, original will be kept on file.
